APPLICABLE LAW AND JURISDICTION

Subject to the Money Laundering Regulations 2007 (as updated) and the London Local Authorities Act 2007 (where applicable) we are required to verify the identity of both you and your business. This is a statutory obligation imposed on us which relates to Mail Forwarding Businesses. We will check against other databases (public or otherwise) to verify the information provided in any form filled by you. By submitting any form you give us the authority to do this.
With regard to the Data Protection Act of 1998 the information you provide on our forms will be used to verify your identity. This information will be held in our accounting and database systems and will be stored in our secure servers. It will not be passed to any other party without your express permission, unless we are required to do so by law or regulation. We will store the information and our verifications thereof in accordance with relevant legislation (which currently means for a period of five years from when you cease to have a contractual relationship with the SmartLearning), after which it will be destroyed. The Act confers rights of access to information we hold.
For users resident in the UK, these terms and conditions are governed by the laws of England and of Wales and are made between SmartLearningand you.
For users’ resident outside the UK, these terms and conditions are governed by the laws of the State of New York without reference to its principles of conflicts of laws and are made between SmartLearningand you.

COPYRIGHT INFRINGEMENT

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with relevant information as required by the Digital Millennium Copyright Act, 17 U.S.C. 512.

TERMINATION

In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions of Use or revoke any or all of your rights granted under the Terms and Conditions of Use.
Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part.
Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You shall not attempt to gain unauthorized access to any portion or feature of SmartLearninguk.com or any other systems or networks connected to the site or to any of our servers, computer, network, or to any of the services offered on or through our website by hacking, password ‘mining’ or any other illegitimate means.
You shall not probe, scan or test the vulnerability of this site or any network connected to this site nor breach the security or authentication measures on any network connected to SmartLearning. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to smartlearninguk.com or any other customer of the site or exploit Smartlearningor any service or information made available or offered by or through us in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by us.
